ChaletFilms General Selling Terms
Section 1
It is stated in the preamble that the general selling terms apply solely to the Chalet Pointu company, ChaletFilms trademark 's owner, located at 10 Goncourt street, 75011 Paris (intracommunal VAT N° FR82480960426), and to any major person buying items corresponding to normal needs of a household on the website www.chaletfilms.com .
Section 2: Agreement
Once your order is placed on the website www.chaletfilms.com , you shall receive an e-mail validating the ordered items. Than you shall receive a second e-mail informing you of the order dispatch. This e-mail constitutes your order's acceptance par Chalet Pointu and forms the selling agreement between you and us.
However, the goods remain Chalet Pointu's property until the entire price payment.
In other respects, ChaletFilms reserves itself the right to cancel or to refuse any order placed by a customer with whom it would be in dispute concerning a previous order payment.
Section 3: Validation
You declare to be acquainted with and to accept these general selling terms before placing an order. The order validation therefore equals the general selling terms' acceptance.
Chalet Pointu reserves itself the right to modify at any time, fully or partly, the general selling terms. Any extension or modification comes into effect immediately from its application on line and it is considered that any user agrees with it by the mere fact of getting connected to and using the website from this date on.
Section 4: Price
The prices presented on the website www.chaletfilms.com are in Euro, all taxes included (French VAT and other applicable taxes), exclusive of dispatch cost and handling costs.
All the orders of any origin are payable in Euro.
ChaletFilms reserves itself the right to modify at any time its prices, however, the DVDs shall be invoiced based on the price lists in force at the time of the order entering.
Section 5: Customs Duty
The orders placed on the website www.chaletfilms.com and delivered to a country other than metropolitan France may be subject to taxes and customs duties, for which you assume responsibility and which are part of your duty, in so far as you are the importer of goods in question. ChaletFilms is not bound to inform you of the customs duties and taxes applicable to your case. We advise you to inquire of the competent authorities in your country.
Section 6: Payment
Your purchase shall be payed by credit card: Visa, MasterCard and other credit cards.
The card shall be debitted only at the order dispatch.

Section 8: Delivery
The goods are delivered to the address indicated at the time of placing the order on the website www.chaletfilms.com and dispatched within the average period of time indicated on the article form, but ChaletFilms cannot be held responsible for the progress delay.
Any order which is not dispatched within 30 (thirty) days following the order shall be cancelled, except for a contrary stipulation indicated in the sale offer.
In case the dispatch is delayed, you shall receive an e-mail. In this event, and so far as the article has not been dispatched, you can cancel your order, no debit being executed before the dispatch.
Section 9: Term and Availability
As for the articles not stocked in our warehouse, our offers are valid subject to our suppliers' availability.
Section 10: "Satisfied or Refunded" Guarantee
You dispose of a 15 (fifteen) days' notice from your order receipt to return the article which does not suit you. The return expenses are part of your duty. Only the price or purchased articles shall be payed back to you. The right to be returned applies only to the articles unsealed by the customer.

Section 11: Articles Compliance
We commit ourselves to pay you back or to exchange the faulty and damaged articles, or those not corresponding to your order. In this case, we kindly ask you to join to your return a detailed note stating the reason for your claim. We shall proceed, at your request, to pay back or to exchange the article(s) in question. The request must be made within 15 (fifteen) days following your order receipt. The sending expenses as well as the return expenses shall be payed back to you based on the invoiced price.
You also benefit from the legal guarantee concerning hidden flaws.
The offered goods comply with French legislation in force. We decline any responsibility on the assumption that the delivered article would not abide by the law of the country of delivery.
You should check with the local authorities the possibilities to import or to use the articles which you contemplate to order.
We commit ourselves to act with all reasonable care and diligence customarily used in the profession in order to provide our clients with the service we offer. However, we shall not be liable for lapse from our contractual duties, if such lapse is due to an act of God or an event of Force Majeure as defined by French legal regulations.Section 12: Withdrawal Right
According to the sections L.120-20 and following of the Consumption Code, you are subject to a 7 (seven) days' notice to exercise your withdrawal right without having to account for the reasons or paying penalties, except for, should the occasion arise, the return expenses. The 7 (seven) days' notice starts from the goods receipt date. This right applies only to unsealed DVDs.
Section 13: Refunding
The article(s) shall be refunded, whatever the reason, onto your bank account or by a bank check addressed to the customer having placed the order and at the invoicing address. No dispatch as counter-refunding shall be accepted, on any grounds.

Section 15 : Propriété intellectuelle

Therefore, and according to the provisions of the Intellectual Property Code, only the use for private purposes subject to different provisions of the Intelligence Property Code is authorized.
